KompasTV Dituntut Membayar Royalti, Upaya Membungkam Pers terkait KCIC
Redaksi KompasTV berkunjung ke Sekretariat Aliansi Jurnalis Independen (AJI) Indonesia di Jakarta pada Rabu (9/5). Pemimpin Redaksi KompasTV Rosianna Silalahi menyampaikan bahwa KompasTV dan Kompas.com menerima dua tuntutan klaim hak cipta video Youtube (YouTube copyright strike) oleh seorang youtuber (content creator) mitra Kereta Cepat Indonesia China (KCIC).
Video berita yang terkena YouTube copyright strike berdampak pada dismonetisasi dan sulit mengunggah video lain hingga media yang dituntut membayar klaimnya. Jika terkena YouTube copyright strike hingga tiga kali, Youtube akan menutup kanal dan menghapus seluruh video berita.
Tuntutan itu terjadi setelah kedua media tersebut mengunggah pemberitaan tentang utang KCIC yang membengkak Rp8,5 triliun. Seluruh materi visual berita diambil dari akun Youtube resmi PT KCIC. Namun, kemudian seorang youtuber melalui pengacaranya, mengajukan YouTube copyright strike dan meminta KompasTV membayar klaim hak cipta atas seluruh video yang dipakai sebesar Rp1,3 miliar. Menurut KompasTV, tuntutan klaim ke Youtube ini diketahui PT KCIC.
Padahal visual yang dipersoalkan youtuber tersebut pernah digunakan membuat berita tentang proyek kereta api cepat, dan diputar di sela perhelatan G20 pada bulan November 2022. Saat itu, penggunaan materi visual KCIC tidak dipersoalkan.
Melihat kasus ini, AJI dan LBH Pers menilai tuntutan klaim hak cipta video Youtube (YouTube copyright strike) upaya untuk membungkam Kompas TV dan Kompas.com. Sebab, konten video dari youtube yang kemudian di dipublikasikan di kanal PT KCIC, merupakan informasi yang berkaitan dengan kepentingan publik sehingga harus diketahui oleh publik.
PT KCIC merupakan perusahaan patungan antara konsorsium BUMN melalui PT Pilar Sinergi BUMN Indonesia (PSBI) dan konsorsium perusahaan perkeretaapian Tiongkok melalui Beijing Yawan HSR Co.Ltd. Proyek dari perusahaan ini yaitu Kereta Cepat Jakarta-Bandung yang merupakan salah satu Proyek Strategis Nasional (PSN) pemerintah Indonesia. Artinya publik berhak untuk tahu tentang perkembangan yang terjadi di PT KCIC.
Di sisi lain, KompasTV dan Kompas.com yang menjadi bagian dari pers nasional memiliki fungsi kontrol sosial sehingga berkewajiban untuk mengawasi penggunaan uang publik di PT KCIC. Hal ini sesuai dengan Pasal 3 Undang-Undang Pers. Karena itu, perusahaan atau masyarakat sudah semestinya tidak boleh membatasi pers dalam menjalankan fungsi kontrolnya.
Atas dasar itu, AJI Indonesia dan LBH Pers mendesak:
1. PT KCIC atau badan publik lainnya untuk menjamin informasi di website atau akun YouTube milik badan publik aman digunakan oleh pers sehingga fungsi kebebasan pers tidak terhambat oleh gugatan-gugatan yang tidak perlu. Gugatan-gugatan tersebut dapat menghambat kerja-kerja jurnalistik dan merugikan publik karena berpotensi menghilangkan fungsi kontrol sosial pers.
2. Perusahaan atau masyarakat yang merasa dirugikan pemberitaan agar menempuh mekanisme yang diatur dalam Undang-Undang Pers. Di antaranya meminta hak koreksi, hak jawab, ataupun melapor ke Dewan Pers.
